BYLAWS
PREAMBLE
We, the Associated Students of Hawai’i Community College, pledge
to forge a community which is student oriented hereby establish a
democratic system of government committed to fellowship and service;
and insist on preeminent learning establish these Bylaws.
ARTICLE I - IDENTITY
Section 1. Name:
The name of this organization shall be the Associated
Students of the University of Hawai’i-Hawai’i Community College,
hereinafter, abbreviated ASUH-HawCC.
Section 2. Colors:
The official colors shall be Maroon and White.
Section 3. Mascot:
The official mascot shall be the Hawaiian Hawk (‘Io).
Section 4. Motto:
The motto shall be "Aha Hui O Ka ‘Io". (The
Assembly of the Hawks).
Section 5. Relationship with UH BOR:
ASUH-HawCC is a chartered student organization (CSO) to carry
out functions or operations on behalf of the University for the
purpose of serving the entire Student Body of HawCC.
ARTICLE II – OBJECTIVES
Section 1. Student Governance:
ASUH-HawCC represents the students of Hawai`i Community
College. It’s main focus and duties include research, education
and action related to the community college.
Section 2. Awareness:
Promotes awareness of issues, gains support for changes and
initiates actions to create the desired campus environment
Section 3. Advocacy:
Advocates for community college and student issues at the
county, state and federal government levels
Section 4. Policy Making:
Provides representative input on policies and decisions
affecting instruction and student services for HawCC students
Section 5. Co-curricular Services:
Implements co-curricular programs and services of interest
that benefit HawCC students
Section 6. Fiscal Stewardship:
Practices responsible fiscal stewardship of the mandatory
student fees collected by the College on behalf of the Student
Body.
ARTICLE III – GENERAL MEMBERSHIP
Section 1. General Membership:
A student whose home campus is HawCC and who is enrolled in
at least one (1) credit offered by HawCC is a member of
ASUH-HawCC.
ARTICLE IV – SENATE
Section 1. Governance:
The governance of ASUH-HawCC shall be the Senate, which
consists of the Executive Board and Senators-At-Large.
Section 2. Powers and Duties of the Senate:
A. The Senate shall have the legislative powers.
B. The Senate shall make all policies necessary and
proper for the conduct of ASUH-HawCC.
C. The Senate shall be directly responsible for the
general welfare and development of the ASUH-HawCC.
D. The Senate shall approve a yearly budget by August
1.
E. The Senate shall appoint from its Senate members,
two delegates and one alternate to the UH Student Caucus for a
one-year term. They must have served at least one semester as a
Senator-at-Large prior to their appointment.
F. The Senate shall approve all appointments made by
the President by majority vote.
G. The entire Senate shall by two-thirds (2/3) majority
vote have the power to override the veto of the President.
H. Every Senate member should serve on at least two (2)
standing committees.
I. Every Senate member is expected to attend mandatory
trainings.
Section 3. Senate Meetings:
A. The President shall call meetings of the Senate. The
Senate shall meet weekly. The day, time and place agreeable to
the majority of the Senate shall be determined on a
semester-by-semester basis.
B. A quorum shall be two (2) members of the Senate,
including two (2) Executive Board members.
C. When any fiscal overrides from the allocated budget
are necessary in any meeting, the quorum is expected to include
the Treasurer.
Section 4. Special Senate Meetings:
A. A special meeting may be called by the President.
B. A special meeting may be called by two (2) members
of the Senate and must include two (2) Executive Board members
to form a quorum.
C. Notice of time, place and exact purpose of the
meeting must be given via verbal communication at least two (2)
hours before desired meeting time with confirmation of
communication by at least two (2) members.
Section 5. Term of Office of Senate Members:
The term of office shall be one academic year – from June 1st
to May 31st.
Section 6. Stipends:
Executive Board members and Senators-At-Large will each
receive a stipend for required service hours on a monthly basis
from the student fees collected by the College.
ARTICLE V - EXECUTIVE BOARD
Section 1. Membership:
The Executive Board shall be composed of the President,
Vice-President, Recording Secretary, and Treasurer.
Section 2. Qualifications:
A. Candidates must have completed a minimum of nine (9)
credits prior to election.
B. Candidates must serve a minimum of one (1) semester
as a Senator-At-Large.
C. Executive Board candidates must have a minimum
cumulative GPA of 2.0 at the time of nomination and throughout
the tenure of office.
D. An Executive Board member shall be registered for at
least six (6) credits per semester.
E. In the event that any Executive Board position
cannot be filled due to candidates not meeting requirements
stated in Article V, section 2B, the position will be open to
any Hawai’i
Community College student who meets
requirements stated in Article V, section 2A, 2C, and 2D.
Section 3. Powers of the Executive Board:
A. The Executive Board is the administrative body of
ASUH-HawCC. It shall carry out its objectives as stated in the
Bylaws.
B. The Executive Board shall review the annual budget
of income and expenditures from the Finance Committee and submit
it to the Senate for approval.
C. The Executive Board shall investigate, hear, and/or
report to the Senate on matters especially referred to them by
the administration, students, staff, and faculty of the College.
D. The Executive Board shall meet twice monthly between
Senate meetings to discuss and prepare for Senate and committee
meetings.
Section 4. Executive Board Meetings:
A. The President shall call bimonthly meetings. The
choice of day, time and place of the meeting will be determined
by the Executive Board.
B. A quorum shall be three (3) members of the Executive
Board or two (2) members in the event of vacancies.
C. When any fiscal overrides from the allocated budget
are necessary in any meeting, the quorum must include the
Treasurer.
Section 5. Powers and Duties of the President:
A. As chief presiding officer, the President is
responsible for enforcing the Bylaws.
B. The President shall preside at all meetings of the
Executive Board and Senate.
C. The President or the President’s designee shall
officially represent ASUH-HawCC on and off the campus in all
matters concerning student representation unless stated
otherwise in the Bylaws.
D. The President is an ex-officio member of all
Standing Committees and ad hoc committees and shall have the
power to vote.
E. The President may make appointments to various
Committees and delineate the specific tasks for all Committees,
subject to approval by the Senate.
F. The President shall be required to make a
Presidential report to the Senate at the end of each semester.
G. The President shall vote in Executive and regular
meetings only in case of a tie.
Section 6. Powers and Duties of the Vice President:
A. In the event that the President cannot fulfill the
duties of the President, the Vice-President shall assume the
position with all its powers and duties.
B. The Vice-President serves as Sergeant-at-Arms to
assist the Senate with keeping the meetings in order.
C. The Vice-President will serve as a mentor for all
new members regarding ASUH-HawCC matters.
D. The Vice-President will serve as Legislative
Committee Co-Chair.
E. The Vice-President will serve as Student Life
Council Liaison and attend meetings as needed.
F. The Vice-President will serve as Senate Committees
Liaison.
G. The Vice-President shall be required to make a
Vice-Presidential report to the Senate at the end of each
semester.
Section 7. Powers and Duties of the Recording Secretary:
A. The Recording Secretary records all minutes of the
Executive Board and Senate meetings.
B. The Recording Secretary is authorized to appoint a
secretary pro tempore for meetings in the Secretary’s absence.
C. The Recording Secretary notifies each Executive Board
member, Senator-at-Large, and the Advisor of regular meetings.
D. The Recording Secretary submits the approved minutes
of the Executive Board and Senate meetings to the Advisor to
post on the ASUH-HawCC website.
E. The Recording Secretary handles all ASUH-HawCC
public relations and related correspondence.
F. The Recording Secretary shall be required to make a
Secretarial report to the Senate at the end of each semester.
Section 8. Powers and Duties of Treasurer:
A. The Treasurer works with the ASUH-HawCC Advisor and
Fiscal Officer of the College and manages all financial
transactions.
B. The Treasurer gives a report to the Executive Board
and Senate at every regular meeting or as requested.
C. The Treasurer works with the Assistant Student Life
Coordinator to ensure that all fiscal documents are processed in
a timely manner to maintain accurate fiscal records.
D. The Treasurer maintains a book of accounts showing
revenue and expenses.
E. The Treasurer will be the Chairperson of the Finance
Committee.
F. The Treasurer shall be present at meetings when any
fiscal overrides from the allocated budget are being considered.
G. The Treasurer will submit a written report of
finances to the Executive Board and Senate at the end of each
semester.
H. The Treasurer will be required to close fiscal
accounts by December 31 and May 31.
I. The Treasurer will submit the proposed approved
annual budget should be submitted to the Dean and Chancellor by
August 1.
ARTICLE VI – SENATE:
SENATORS-AT-LARGE
Section 1. Senators-at-Large:
A. Three (3) Senators shall be
elected At-Large. Each will be assigned to represent students
from one (1) of the following programs:
· Associate in
Arts (AA) Degree and related certificate programs
· Associate in
Applied Science (AAS) Degree and related certificate
programs
· Associate in
Science (AS) Degree and related certificate programs
B. One (1) Senator-at-Large shall be elected to represent
West Hawaii HawCC students and will be elected by them.
Section 2. Qualifications of Senators-at-Large:
A. Candidates must have completed a minimum of nine (9)
credits prior to election.
B. Executive Board candidates must have a minimum cumulative
GPA of 2.0 at the time of nomination and throughout the tenure
of office.
C. An Executive Board member shall be registered for at least
six (6) credits per semester.
ARTICLE VII – COMMITTEES
Section 1. Standing Committees:
A. The Finance Committee shall be chaired by the
Treasurer and composed of three (3) committee members. The
committee shall prepare a yearly budget of income and expenses
for review by the Executive Board and approval by the Senate by
August 1.
B. The Elections Committee shall consist of at least
two (2) members to make rules and supervise campaigns and
elections for the positions of the Executive Board and
Senators-at-Large. It will be facilitated by Advisors and not
include members running for office.
C. The Student Issues Committee shall consist of at
least two (2) members who will research and respond to student
concerns about various issues that affect their educational
experience.
D. The Legislative Committee shall consist of two (2)
members who will research, communicate and advocate on
legislative issues.
E. Standing committees may include volunteers from the
Student Body who are not a part of the Senate.
Section 2. Committee Meetings:
Standing Committees, except Election Committee, shall meet no
later than two (2) weeks after the first meeting of the Senate
and thereafter at the discretion of the Chairperson as the need
arises.
Section 3. Ad Hoc Committees:
The President may appoint ad hoc committee(s) whenever the
need for special action, investigation, or report(s) arises.
ARTICLE - VIII ADVISORS
Section 1. Powers and Duties of the Advisor(s):
A. The Advisor shall advise the Executive Board,
Senate, and its Committees, and through whom all official
business will be communicated.
B. The Advisor will approve and co-sign all
requisitions submitted by the Treasurer.
C. The Advisor shall be required to make an Advisor’s
report at the end of each semester.
ARTICLE IX – NOMINATIONS AND
ELECTIONS
Section 1. Nominations:
Candidates for each office may be nominated by submitting an
application to run for office to the Advisor not less than
fifteen (15) calendar days prior to the elections.
Section 2. Elections:
A. The Elections Committee composed of at least three
(3) members shall develop rules and regulations to conduct the
elections in the spring semester. It will be facilitated by the
Advisor and not include members running for office.
B. Elections of all Officers and Senators shall be by
secret/electronic ballot by members of ASUH-HawCC.
C. Candidates for the Senate shall be elected by
plurality votes cast by HawCC students.
D. In case of a one-vote difference, the candidate(s)
involved may request a recount.
E. Members of the Election Committee who are not
candidates for office of that election shall tabulate ballots
and the results will be posted immediately.
F. ASUH-HawCC elections for the Senate shall be held by
the last week of April.
ARTICLE X – VACANCIES AND
RESIGNATIONS
Section 1. Vacancies:
In the event that a Senate seat, except for the President,
has not been filled within 30 days after elections, that seat
shall be filled by appointment by the President with advice and
consent of the Senate. The appointee shall meet the
qualifications for that office. The vacant seat for the
President shall be filled by the Vice-President.
Section 2. Resignations:
In the event that any Officer, except for the President, or a
Senator-at-Large cannot serve for whatever reason, that seat
shall be filled by appointment by the President with advice and
consent of the Senate. The appointee shall meet the
qualifications of that office. If the President cannot serve,
the Vice-President shall assume the position.
ARTICLE XI – REMOVAL AND RECALL
Section 1. Removal:
The entire Senate shall by two thirds (2/3) majority vote
have the power to remove an Executive Officer or a
Senator-At-Large for cause, to include disruptive,
irresponsible, or unethical actions, using Robert’s Rules
Chapter XX – Disciplinary Procedures.
Section 2. Recall:
Removal by recall of an Executive Board member or
Senator-at-Large shall be made upon presentation of a petition
bearing verified signatures of 10% of the Student Body. The
Senate shall call for a special election within fifteen (15)
days of receiving the petition.
ARTICLE XII – PLEBESCITE
Section 1. Procedures:
Any member of the student body may present a petition to the Senate
requesting legislation on any matter within the Senate’s authority. The
petition must bear verified signatures of 10% of the student body. The
Senate shall submit the petition to vote by the Student Body no sooner
than fifteen (15) days and no later than thirty (30) days after
receiving the verified petition.
ARTICLE XIII - AMENDMENTS
Section 1. Origination in the Senate:
The Bylaws may be amended by "A Bill to Amend the Bylaws". A
two- thirds (2/3) majority of the members assembled is required
to approve the amendment by the Senate. The bill to amend the
Bylaws shall be submitted to a referendum of ASUH-HawCC within
fifteen (15) days thereafter. A majority of votes cast by the
Student Body is necessary for the ratification to amend the
Bylaws.
Section 2. Petition to Amend the Bylaws:
The eligible students of HawCC may present a "Petition to
amend the Bylaws" to the Recording Secretary of the Senate. The
petition must contain the signatures of ten percent (10%) of
eligible student voters. A two-thirds (2/3) vote of the Senate
assembled ratifying such a "Petition to Amend the Bylaws" shall
be sufficient to effectuate the Amendment.
ARTICLE XIV – RULES OF ORDER
Section 1. Rules of Order:
Simple courtesy and Robert’s Rules of Order for
Parliamentary Procedure, latest edition, shall govern the
deliberations and proceedings of the Executive Board, Senate and
Committees, subject only to the special rules that are
established by these Bylaws.
ARTICLE XV - APPROVAL AND EFFECTIVE
DATE OF BYLAWS
Section 1. Approval:
A. Upon approval of two-thirds (2/3) of the members of the
Senate assembled the
Bylaws shall be presented to the Student Body for ratification.
B. A majority of all votes cast affirmatively by the Student
Body is necessary for ratification of the Bylaws and requires
certification by the Chancellor of Hawai’i Community College.
